These Terms of Service (“Terms”) govern your access to and use of the CentriCall AI Voice Agent platform, website, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

CentriCall is developed and operated by Centricone Technologies. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You must be at least 18 years old and capable of forming a binding contract to use the Services. You are responsible for ensuring that your use of the Services complies with all laws and regulations that apply to you.

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Keep your account credentials secure and confidential
• Be responsible for all activity that occurs under your account
• Notify us promptly of any unauthorized use of your account

We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services in accordance with these Terms. You agree not to:

• Use the Services for any unlawful, harmful, or fraudulent purpose
• Place calls or send communications without required consent
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems
• Reverse engineer, copy, or resell the Services without our written permission
• Use the Services to violate the rights of any third party

Where call recording, transcription, or automated calling features are enabled, you are solely responsible for obtaining and maintaining all consents and notices required by applicable law. You agree to use these features in compliance with all telecommunications, privacy, and recording laws that apply to you and your customers.

• Fees for the Services are described in your applicable plan or order
• Unless stated otherwise, fees are billed in advance and are non-refundable
• You authorize us to charge your designated payment method for all fees due
• We may change our fees with reasonable prior notice

The Services, including all software, content, and trademarks, are owned by Centricone Technologies or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted to you, these Terms do not transfer any ownership or rights in the Services to you.

You retain ownership of the data you and your customers provide through the Services. You grant us a limited license to process that data as necessary to provide, maintain, and improve the Services, in accordance with our Privacy Policy.

The Services may integrate with third-party products and services. We are not responsible for the availability, accuracy, or content of third-party services, and your use of them is governed by their own terms and policies.

We aim to keep the Services available and reliable, but we do not guarantee that they will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, Centricone Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Services. Our total liability for any claim shall not exceed the amount you paid for the Services in the twelve months preceding the claim.

You agree to indemnify and hold harmless Centricone Technologies and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we reasonably believe your use poses a risk to us, other users, or third parties. You may stop using the Services at any time. Provisions that by their nature should survive termination will continue to apply.

We may update these Terms from time to time. Updated versions will be posted on our website with a revised effective date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws applicable at the place of business of Centricone Technologies, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in that location.
